Henderson Nevada Attorney: Legal Services for Henderson Residents and Businesses

Henderson is Nevada's second-largest city, with 317,610 residents at the 2020 census, and it runs its own city government, its own business licensing and its own municipal court. A Henderson Nevada attorney has to know which of those systems a problem belongs to before anything else happens. Milan Legal represents individuals, families and businesses throughout Henderson, from Green Valley and Anthem to Inspirada and the Water Street district, on matters governed by Nevada law and heard in Clark County courts.

Attorney Milan Chatterjee is licensed in Nevada (Bar No. 15159) and California, and he works directly with every client from the firm's Las Vegas office. When a dispute, a contract, a property problem or a criminal charge needs attention, an early review usually leaves more options open.

Milan Legal handles business, real estate, landlord-tenant, HOA, employee-side employment, estate planning, litigation and criminal defense matters for Henderson clients. Civil claims up to $15,000 and evictions go to Henderson Justice Court, misdemeanors inside city limits go to Henderson Municipal Court, and larger civil cases and felony trials go to the Eighth Judicial District Court.

Legal Matters We Handle for Henderson Clients

Most Henderson matters fall into a handful of practice areas. Each link below opens the full practice page with the Nevada law behind it.

  • Business law and outside general counsel: entity formation, contracts, vendor and lease disputes, and ongoing counsel for Henderson companies that answer to both the state and the city.

  • Employment law for employees: wrongful termination, discrimination, harassment, retaliation and unpaid wages for people who work in Henderson.

  • Real estate and landlord-tenant matters: purchase disputes, title problems, lease conflicts and summary eviction proceedings under NRS 40.253.

  • HOA disputes: fines, assessments, architectural denials and records requests in Henderson's master-planned communities.

  • Civil litigation: contract, business and personal claims in Henderson Justice Court and the Eighth Judicial District Court.

  • Criminal defense: misdemeanor and felony charges, including DUI, from first appearance onward.

  • Wills, trusts and estate planning: plans that account for Nevada community property and Henderson real estate holdings.

Why Henderson Legal Matters Need Local Knowledge

Henderson grew one community at a time. Green Valley was Southern Nevada's first master-planned community, and Green Valley Ranch, Seven Hills, MacDonald Ranch, Anthem, Inspirada, Cadence and Lake Las Vegas followed. A large share of Henderson homes therefore sit inside an association governed by NRS Chapter 116, and property questions here often start with the CC&Rs rather than the deed. Before a civil action over the interpretation or enforcement of those governing documents can be filed, Nevada generally requires the dispute to be submitted first to mediation, or by agreement to a dispute resolution program, through the Nevada Real Estate Division (NRS 38.310). Skipping that step is costly, because a court must dismiss an action filed without it.

Business owners face a second layer. Every business operating in Nevada needs a state business license through the Secretary of State, and a business operating inside Henderson city limits also needs a City of Henderson business license. The city's application asks for proof of the active state license and a Nevada Department of Taxation permit or exemption, so a gap at the state level stalls the local one. The city offers an address verification tool because some addresses that read "Henderson" are actually in unincorporated Clark County, and that boundary also decides which court hears a misdemeanor.

Employment questions follow the same pattern. Henderson employers range from casinos and hospitals to warehouses and corporate offices, and each brings its own policies and pay practices. Nevada wage and anti-discrimination statutes apply statewide, but the facts that win or lose a claim are local: the handbook, the schedule, the supervisor and the paper trail.

Not sure which court or agency your Henderson matter belongs in? That is the first thing we sort out, before any deadline passes.

Henderson Courts and Where Your Case Will Be Heard

Henderson sits in Clark County's Eighth Judicial District, but most cases start closer to home. Two of the four courts below share one building on Water Street, which surprises many first-time visitors.

CourtWhat It HearsLocation

Which court hears a criminal case depends on the level of the charge and where the conduct happened, not on where the accused person lives. A misdemeanor inside city limits is prosecuted by the Henderson City Attorney in municipal court, while a felony starts in Henderson Justice Court and moves to district court only if the case is bound over after the preliminary hearing. On the civil side, the dollar amount controls: justice court jurisdiction stops at $15,000 (NRS 4.370), and small claims stop at $10,000 (NRS 73.010). For anything larger, or for a case that needs an injunction, the filing goes to the Regional Justice Center in downtown Las Vegas.

Henderson Nevada Attorney FAQs

Do I need an attorney based in Henderson, or can a Las Vegas attorney handle my case?

Henderson cases are heard in Clark County courts, either at the Water Street justice facility or at the Regional Justice Center in Las Vegas. What matters is a Nevada license and working knowledge of those courts, not an office inside city limits. Milan Legal is based in Las Vegas and represents Henderson clients in all of them.

Where do I file a small claim against a Henderson business?

You can file in Henderson Justice Court if the defendant lives, works or does business in Henderson Township. Small claims are limited to $10,000 (NRS 73.010), and attorney's fees generally are not awarded to either side in small claims cases (NRS 73.040).

Which court handles a DUI arrest in Henderson?

A misdemeanor DUI that happens inside Henderson city limits is heard in Henderson Municipal Court. A felony DUI begins in Henderson Justice Court and moves to the Eighth Judicial District Court if it is bound over after the preliminary hearing.

Does my business need a City of Henderson business license?

Yes, if it operates within Henderson city limits. You also need a Nevada state business license, and the city's application asks for proof of the state license and a Department of Taxation permit or exemption. The city's address verification tool confirms whether your location is inside its jurisdiction.

Can my Henderson HOA and I go straight to court over a CC&R dispute?

Usually not. NRS 38.310 generally requires a civil action over the interpretation or enforcement of an association's governing documents to be submitted to mediation through the Nevada Real Estate Division first, or to a Division program if both sides agree. The exceptions are narrow, such as an injunction where there is an immediate threat of irreparable harm, or an action over title to the property.

How are evictions handled in Henderson?

Residential evictions for property in Henderson Township are heard in Henderson Justice Court, most often through the summary eviction process under NRS 40.253. A tenant who wants to contest the eviction must file an affidavit with the court within the short deadline stated in the notice.

Can I meet with Milan without driving to Las Vegas?

Yes. Consultations are available by phone or video, and in-person meetings take place at the firm's office at 2620 Regatta Drive, Suite 102, Las Vegas.
